The terms you agree to when you take part in a study on Jotter.

1. About these terms
1.1 These Student Terms (these Terms) are an agreement between you and Uncommon Studios Limited, a company registered in England and Wales (company number 17021009) whose registered office is at 167–169 Great Portland Street, London W1W 5PF, and which trades as Jotter Education (Jotter, we, us or our). They apply when you use Jotter to take part in a study set up by your lecturer at app.jotter.education (the Service).
1.2 By opening a study link and taking part, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Service.
2. Some words we use
2.1 A few terms appear throughout these Terms:
- Study means the space your lecturer sets up for your module or cohort.
- Activity means an interactive item within a Study (such as a case, quiz or simulation).
- Submission means anything you contribute through the Service, such as an answer, a question, a rating or feedback.
- Privacy Notice means our privacy policy.
3. How to contact us
3.1 You can contact us at hello@jotter.education. For anything about your course, marks or assessment, please speak to your lecturer or institution.
4. How Jotter works for you
4.1 You join a Study using a link or join code from your lecturer. You do not need to create an account. Once you are in a Study, you can work through Activities and contribute Submissions.
4.2 Jotter is there to support your learning. It is not the official record of your marks or assessment; that sits with your lecturer and institution.
5. Who can use Jotter
5.1 You take part in Jotter as a member of a course or cohort at an institution that uses the Service. You should be at least 18 years old. If you are under 18, your lecturer or institution is responsible for making sure the right permissions and consents are in place before you take part.
6. Using Jotter properly
6.1 Please use Jotter respectfully and lawfully. In particular, you agree not to:
- post anything unlawful, offensive, harassing, discriminatory or that infringes someone else's rights;
- pretend to be someone else, or try to identify other participants who have contributed anonymously;
- copy, share or sell the Activities or other Jotter content outside your Study; or
- try to disrupt, damage or gain unauthorised access to the Service or any connected systems.
6.2 If you break these rules, we (or your lecturer) may remove your contributions or stop your access to a Study.
7. Your questions, answers and feedback
7.1 When you take part, your answers, questions, progress and feedback are shared with the lecturer running the Study, and some contributions may be shown to other participants: for example, when a lecturer publishes an answer to a question for the whole group.
7.2 Where a question or contribution is described as "anonymous", it is not shown next to your name within the Service. To keep it anonymous, please do not include your name or other identifying details in what you write.
7.3 You keep ownership of your Submissions. You give us permission to host, store, copy, display and process them so we can provide the Service to you and to your lecturer.
8. Jotter's content
8.1 Jotter, the Activities and everything we provide (apart from your own Submissions) belong to us or our licensors and are protected by law. You may use them for your own learning within your Study, but you must not copy, share or reuse them elsewhere without our permission. Jotter and our logos are our trade marks.
9. Your privacy
9.1 We handle personal data in line with UK data protection law and our Privacy Notice, which explains what we collect and how it is used. Your lecturer and institution are also responsible for how your data is used in connection with your course. If you have questions about that, please ask them.
10. Cost
10.1 You do not pay anything to use Jotter. Access is arranged and paid for by your institution.
11. Availability
11.1 We try to keep Jotter available and working well, but we cannot guarantee it will always be available, uninterrupted or error-free. We may occasionally suspend it for maintenance or for reasons outside our control.
12. Disclaimers
12.1 Jotter and the Activities are provided for learning purposes only and are not professional, financial, legal or other advice. To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we do not guarantee that any Activity is accurate, complete or up to date.
12.2 We also do not promise that using Jotter will lead to any particular learning result, grade or level of understanding. How much you get out of it depends on how you and your course use it.
13. Our liability
13.1 Liability we do not exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded. Nothing in these Terms affects your rights as a consumer that cannot be excluded by law.
13.2 Losses we are not liable for. Subject to clause 13.1, we are not liable for any loss of data, or any indirect or consequential loss, and we are not responsible for decisions made by your lecturer or institution about your course, marks or assessment.
13.3 Cap on our liability. Subject to clause 13.1, our total liability to you arising out of or in connection with these Terms or your use of the Service is limited in aggregate to £100 (one hundred pounds).
14. Changes to these terms
14.1 We may update these Terms from time to time. The version that applies is the one published or shown to you when you use the Service. If we make a material change, we will take reasonable steps to let you know.
15. Governing law
15.1 These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may also be able to bring a claim in your local courts.
