1. Who we are and these terms

1.1 This website at jotter.education (the Site) is operated by Uncommon Studios Limited, a company registered in England and Wales (company number 17021009) whose registered office is at 167–169 Great Portland Street, London W1W 5PF, and which trades as Jotter Education (Jotter, we, us or our).

1.2 These terms of use (these Terms) tell you the rules for using the Site. They apply to every visitor to the Site, whether or not you are a registered user of the Jotter platform.

1.3 By using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree, please do not use the Site.

1.4Other terms that may apply. Your use of the Jotter platform itself (at app.jotter.education) is governed by our separate End User Licence Agreements (the Academic Terms and Student Terms), not by these Terms. Our Privacy Notice also applies to your use of the Site.

2. Changes to these terms and the Site

2.1 We may amend these Terms at any time by updating this page. Please check this page from time to time; the version in force is the one published here when you use the Site.

2.2 We may update and change the Site from time to time, and may suspend, withdraw or restrict the availability of all or any part of it for business or operational reasons. We will try to give reasonable notice of any major change or suspension where practicable.

3. Accessing the Site

3.1 The Site is made available free of charge. We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Site for business and operational reasons.

3.2 You are responsible for making any arrangements necessary to access the Site, and for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

4. Acceptable use

4.1 You may use the Site only for lawful purposes. You may not use the Site:

4.3 We may determine whether there has been a breach of this acceptable use section, and may take such action as we consider appropriate, including withdrawing your right to use the Site and/or reporting the matter to law enforcement.

5. Intellectual property rights

5.1 We are the owner or the licensee of all intellectual property rights in the Site and the material published on it. Those works are protected by copyright and other laws and treaties around the world. All such rights are reserved.

5.2 You may print off one copy, and may download extracts, of any page from the Site for your own personal, non-commercial reference, but you must not use any part of the content on the Site for commercial purposes without a licence from us.

5.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

5.4 Jotter, the Jotter logos, and our other names and marks are trade marks of Uncommon Studios Limited. You may not use them without our prior written permission.

6. No reliance on information

6.1 The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.

6.2 Although we make reasonable efforts to update the information on the Site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date.

7. Linking to and from the Site

7.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

7.2 We reserve the right to withdraw linking permission without notice.

7.3 Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

8. Information you submit through the Site

8.1 If you submit information through the Site (for example, through the contact form), you confirm that the information you provide is accurate and that you have the right to provide it. We will handle any personal data you submit in accordance with our Privacy Notice.

8.2 We may use the information you submit to respond to your enquiry and for related business purposes as described in our Privacy Notice.

9. Privacy and cookies

9.1 We process personal data collected through the Site in accordance with the UK General Data Protection Regulation, the Data Protection Act 2018 and our Privacy Notice. The Site uses only strictly necessary cookies and local storage, as described in our Privacy Notice; we do not use tracking, advertising or analytics cookies.

10. Our liability

10.1Nothing excluded that cannot be. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

10.2Site provided "as is". To the extent permitted by law, we exclude all conditions, warranties, representations or other terms that may apply to the Site or any content on it, whether express or implied. The Site is provided on an "as is" and "as available" basis.

10.3No liability for certain losses. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with use of, or inability to use, the Site or reliance on any content on it. In particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

11. Viruses and security

11.1 We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Site, and you should use your own virus protection software.

11.2 You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site. Breach of this provision may be a criminal offence; we will report any such breach to the relevant law enforcement authorities and co-operate with them.

12. Governing law and jurisdiction

12.1 These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales have exclusive jurisdiction.
